These Terms of Service (hereinafter "Terms") apply to the use of the mobile application "RunningCrewHome" (hereinafter "App") and related services provided by Michael Markowitz (hereinafter "Provider").
By installing, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, you may not use the App.

The Provider grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

When participating in running crews, you agree to:
You retain all rights to content you upload or create in the App. By uploading, you grant the Provider a worldwide, non-exclusive license to use, store, and display this content as part of providing the Service.
All rights to the App, including design, logo, code, and trademarks, remain with the Provider. You receive no rights except the expressly granted usage license.
The basic version of the App can be used free of charge and includes basic features.
A Premium subscription can be purchased for advanced features:
Refunds are governed by the respective App Store policies (Apple App Store). The Provider has no influence on refund decisions.
The collection, processing, and use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.
The Provider strives for uninterrupted availability of the App but cannot guarantee it. Maintenance, technical issues, or force majeure may result in temporary outages.
The Provider reserves the right to:

The App is provided "as is." The Provider makes no warranty regarding:
The Provider is only liable for damages based on intent or gross negligence. Liability for simple negligence is excluded to the extent legally permissible.

Users should check their health condition before athletic activities and consult a physician if concerned.
You may terminate your account at any time by deleting it in the App or emailing runningcrewhome@gmail.com.

The Provider reserves the right to modify these Terms. Significant changes will be communicated to users at least 30 days before taking effect via email or in-app notification.
Continued use of the App after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you may terminate your account.
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.
The place of jurisdiction for all disputes is, to the extent legally permissible, the Provider's registered office.
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
Should individual provisions of these Terms be or become invalid, this does not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
