1. Scope

These Terms of Service (hereinafter "Terms") apply to the use of the mobile application "RunningCrewHome" (hereinafter "App") and related services provided by Michael Markowitz (hereinafter "Provider").

By installing, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of Service

RunningCrewHome is a mobile application that enables runners to:

• Sync and view their Strava activities
• Create, manage, and join running crews (running groups)
• Organize and coordinate group runs
• Communicate with other runners
• Create training plans and share routes
• Upload running activities from various file formats

3. User Account and Registration

3.1 Account Creation

Use of the App requires creating a user account. You must:

• Be at least 16 years old
• Provide a valid email address
• Provide true and complete information
• Keep your account information current

3.2 Account Security

You are responsible for:

• Keeping your credentials confidential
• All activities that occur under your account
• Promptly reporting unauthorized account access to the Provider

4. Strava Integration

The App offers the ability to connect your Strava account. By connecting:

• You authorize access to your Strava activity data
• You consent to automatic synchronization of your running activities
• You agree to Strava's Terms of Service
• You can disconnect at any time in settings

5. Usage Rights and Obligations

5.1 License

The Provider grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

5.2 Prohibited Use

You agree not to use the App for:

• Illegal activities or violation of third-party rights
• Distribution of harassing, defamatory, or obscene content
• Spam, phishing, or other fraudulent activities
• Uploading viruses, malware, or harmful code
• Bypassing the App's security measures
• Automated data scraping
• Commercial purposes without written permission

5.3 User Behavior in Crews

When participating in running crews, you agree to:

• Treat other members respectfully
• Not share offensive or discriminatory content
• Respect other users' privacy
• Provide truthful information about your running activities

6. Content and Intellectual Property

6.1 User-Generated Content

You retain all rights to content you upload or create in the App. By uploading, you grant the Provider a worldwide, non-exclusive license to use, store, and display this content as part of providing the Service.

6.2 Provider's Rights

All rights to the App, including design, logo, code, and trademarks, remain with the Provider. You receive no rights except the expressly granted usage license.

7. Premium Features and Payments

7.1 Free Usage (Freemium)

The basic version of the App can be used free of charge and includes basic features.

7.2 Premium Subscription

A Premium subscription can be purchased for advanced features:

• Price: $4.99 per month
• Billing through App Store (Apple)
• Automatic renewal unless canceled at least 24 hours before expiration
• Managed and canceled through App Store settings

7.3 Refunds

Refunds are governed by the respective App Store policies (Apple App Store). The Provider has no influence on refund decisions.

8. Privacy

The collection, processing, and use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

9. Availability and Changes

9.1 Availability

The Provider strives for uninterrupted availability of the App but cannot guarantee it. Maintenance, technical issues, or force majeure may result in temporary outages.

9.2 Service Changes

The Provider reserves the right to:

• Change, add, or remove features
• Update or improve the App
• Discontinue the Service in whole or in part

Users will be appropriately informed of significant changes.

10. Disclaimer

10.1 Warranty

The App is provided "as is." The Provider makes no warranty regarding:

• Uninterrupted, error-free, or secure operation
• Accuracy or completeness of data
• Fitness for a particular purpose

10.2 Limitation of Liability

The Provider is only liable for damages based on intent or gross negligence. Liability for simple negligence is excluded to the extent legally permissible.

The Provider is not liable for:

• Data loss
• Damage caused by third parties or user-generated content
• Indirect or consequential damages
• Loss of business opportunities or revenue

10.3 Athletic Activities

The App is for organizing and coordinating running activities. The Provider is not liable for:

• Injuries or accidents during athletic activities
• Health problems from overexertion
• Damages from participation in organized runs

Users should check their health condition before athletic activities and consult a physician if concerned.

11. Termination and Suspension

11.1 Termination by User

You may terminate your account at any time by deleting it in the App or emailing runningcrewhome@gmail.com.

11.2 Termination by Provider

The Provider may suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or abusive behavior
• Endangering other users or the platform
• Extended inactivity (after prior notice)

11.3 Consequences of Termination

After termination:

• Your access right to the App expires
• Your data will be deleted according to the Privacy Policy
• Already paid fees cannot be refunded
• Your obligations from the usage period remain

12. Changes to Terms

The Provider reserves the right to modify these Terms. Significant changes will be communicated to users at least 30 days before taking effect via email or in-app notification.

Continued use of the App after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you may terminate your account.

13. Dispute Resolution

13.1 Applicable Law

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

13.2 Jurisdiction

The place of jurisdiction for all disputes is, to the extent legally permissible, the Provider's registered office.

13.3 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

14. Severability

Should individual provisions of these Terms be or become invalid, this does not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
